1. Agreement to Terms

These Terms apply to all visitors, users, and clients. Users must be 18 years or older.
2. Description of Services
Scale or Die LLC provides digital marketing and patient-acquisition services for chiropractic practices, including but not limited to:
- Paid advertising management
- Lead generation and qualification campaigns
- Funnel creation and optimization
- CRM setup and automation
- AI conversational, phone, and follow-up agents
- Email marketing
- SMS marketing
- Consulting and strategy services
We reserve the right to modify or discontinue services at any time without prior notice, subject to any written service agreement then in effect.
3. Results and Guarantees
Marketing outcomes depend on factors outside our sole control, including market conditions, competition, offer quality, practice sales process, consult availability, show rates, and advertising platform changes. Past results do not guarantee future results.
Unless a specific written guarantee applies (for example, the consult guarantee described on this website and confirmed in your service agreement), we do not guarantee:
- Specific revenue increases
- Specific lead or care plan volume beyond any written guarantee
- Specific return on ad spend (ROAS)
- Business growth or profitability
- Show rates, closed cases, or revenue from booked consultations
Where a written guarantee applies, its published terms control — including what counts as a “qualified” consult, that ad budgets run through your own accounts, and that the guarantee covers booked consultations as defined, not show rates, closed cases, or revenue.
4. Client Responsibilities
Clients agree to:
- Provide accurate business information
- Provide timely access to ad accounts, websites, calendars, and CRM systems
- Approve or reject campaigns in a timely manner
- Comply with advertising platform policies
- Handle all clinical care, sales, fulfillment, and patient/customer service related to generated leads and booked consults
- Ensure proper consent is obtained for SMS, email, and patient marketing materials (including before/after creative)
- Enter into a Business Associate Agreement (BAA) when required for handling protected health information
Failure to provide required access or cooperation may delay results and does not constitute grounds for refund, except as expressly stated in a written agreement.
5. Payments and Billing
- All fees are outlined in your service agreement or invoice
- Payments are due according to the agreed billing schedule
- Late payments may result in suspension of services
- Ad spend is separate from management fees unless otherwise stated
- All payments are non-refundable unless otherwise stated in writing
We reserve the right to use third-party payment processors, including Stripe.
6. SMS Messaging Terms
By providing your phone number through this website or any associated landing pages, you consent to receive SMS communications from Scale or Die LLC or our client practices, which may include appointment reminders, marketing messages, promotional offers, follow-up messages, and customer service communications.
Message Frequency: Message frequency may vary depending on user interaction and campaign activity.
Message & Data Rates: Message and data rates may apply depending on your mobile carrier plan.

Upon full payment, clients are granted a non-exclusive license to use materials for their business purposes.
You may not resell, redistribute, or copy our proprietary systems without written permission.
9. Third-Party Platforms
Scale or Die LLC is not affiliated with or endorsed by Meta Platforms, Google, TikTok, or any other advertising platform. We are not responsible for account suspensions, ad rejections, platform outages, or policy changes. Clients are responsible for complying with each platform’s terms and advertising policies.
10. Limitation of Liability
To the fullest extent permitted by law, Scale or Die LLC shall not be liable for loss of revenue, loss of data, business interruption, indirect or consequential damages, or platform bans or advertising account restrictions.
Our total liability shall not exceed the amount paid for services in the previous 30 days, except where a written service agreement expressly provides otherwise.
11. Confidentiality
We agree to keep client business information confidential and not disclose it to third parties except as required to perform services or by law. Clients agree not to disclose proprietary processes, strategies, or systems used by Scale or Die LLC.
12. Termination
Either party may terminate services according to the signed service agreement (including month-to-month arrangements described on this website). Upon termination, outstanding balances remain due, active campaigns may be paused, and access to proprietary systems may be revoked.
13. Refund Policy
Unless otherwise stated in a written agreement:
- All service fees are non-refundable
- Advertising spend paid to third-party platforms is non-refundable
- Setup fees are non-refundable
If a written guarantee on this website or in your agreement entitles you to not pay under defined conditions, that written guarantee controls for that fee.
14. Disclaimer
All information on this website is provided for informational purposes only and does not constitute legal, financial, medical, or business advice. Illustrative revenue calculations and targets on this site are estimates based on disclosed assumptions, not promises of your results.
15. Governing Law
These Terms shall be governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts located in Florida.
